Fidelity Class Action Claims Data Breach Compromised Customer Data

Fidelity Investments failed to adequately protect its computer network during a “massive and preventable” data breach in August, a new class action lawsuit alleges.

Plaintiffs Yaakov Gluck and Steven Gluck’s class action lawsuit claims the Fidelity data breach allowed cybercriminals to steal “everything they could possibly need” to commit “nearly every conceivable” form of identity theft.

“Because Defendant presented such a soft target to cybercriminals, Plaintiffs have already been subjected to violations of their privacy, fraud, and identity theft, or have been exposed to a heightened and imminent risk of fraud and identity theft,” the data breach class action says.

The Glucks want to represent a nationwide class of consumers who had their data compromised during the data breach.

The data breach exposed Social Security numbers, financial information, names, phone numbers and addresses, the Fidelity class action alleges.

Yaakov Gluck and Steven Gluck argue Fidelity failed to implement “adequate and reasonable” measures to ensure their computer systems were protected and failed to take adequate steps to prevent and stop the breach.

The class action lawsuit further argues Fidelity failed to timely detect the data breach and failed to honor their “repeated promises” to protect the consumers’ personal information, among other things.

“Due to the Data Breach, Plaintiffs have experienced anxiety over the public release of his personal information, which he trusted would be safeguarded against unauthorized access and disclosure,” the data breach class action says.

Yaakov Gluck and Steven Gluck allege Fidelity is guilty of negligence and negligence per se and invasion of privacy. The plaintiffs demand a jury trial and request declaratory and/or injunctive relief and an award of actual, statutory and punitive damages for themselves and all class members.

A pair of consumers filed a similar class action lawsuit earlier this year against Fidelity over claims the company and its subsidiary LoanCare failed to properly safeguard and secure the personally identifiable information of consumers during a data breach announced by Fidelity in December 2023.
