Denmark Moves to Ban Non-Consensual Deepfakes of Faces and Voices

Denmark plans to put forward legislation on Thursday aimed at outlawing the distribution of lifelike deepfakes showing individuals' faces and voices without permission.

The planned change to the country's copyright legislation would safeguard members of the public alongside creative professionals, including from synthetic reproductions of what they perform.

Deepfakes refer to pictures, footage or sound created or altered through artificial intelligence so that a person seems to utter or perform actions they never did. Such content may be deployed to circulate inaccurate information or to degrade the individuals shown.

Zenia Stampe, the Danish culture minister , stated that artificial intelligence allows manipulated videos and images to be produced in moments and then disseminated via social platforms. She added that a central aim of the proposal is to compel major technology companies to remove altered material swiftly, minimising the damage it can cause.

The legislation stems from a wide-ranging political deal struck in June 2025 by Jakob Engel-Schmidt, who held the culture minister role in the prior administration, to shield people from digital likenesses used without authorisation.

Carve-outs exist for humour, mimicry, exaggerated portrayal and critiques of authority and society, though these would not extend to falsehoods that create particular severe threats to other people's rights, vital concerns, existence or belongings.

The minister expects the measure to come into force at the beginning of 2027.

Denmark's action occurs as nations worldwide contend with the swift expansion of AI.

EU member states covered by the union's directive addressing violence against women are required to bring it into national law by 14 June 2027. The directive obliges them to make it a crime to produce sexually explicit altered content and then publish it without the agreement of the person shown, in cases where significant harm is likely.

Denmark falls outside the directive's scope owing to its exemption from EU rules on justice and affairs.

France has already outlawed the circulation of AI-made pictures or sound featuring an individual without their permission when the synthetic character of the material is neither evident nor clearly stated. Distinct regulations ban the distribution of sexual deepfakes without consent, no matter how they are labelled.

In the United Kingdom, generating or soliciting intimate deepfakes without consent turned into a criminal act in England and Wales during February. Distributing such material may result in a custodial term of as much as two years.
